Medical / Photo / Video Release & Covenant Not to Sue

I, the undersigned (if participant is 18 years or older), or the undersigned’s parent/legal guardian (if participant is younger than 18 years), acknowledge and fully understand that soccer is a contact sport and that the participant will be engaging in activities that involve risk of injury which might result not only from the participant’s own actions, inactions or negligence, but the actions, inactions or negligence of others, the rules of play, or the condition of the premises, or of any equipment used therewith, whether such injuries occur while observing, practicing or playing soccer or otherwise, and further that there may be other unknown risks not reasonably foreseeable at this time, and assume all of the foregoing risks and accept personal responsibility for any damages following any injury, permanent disability or death, and hereby forever release, discharge, waive, covenant not to sue or otherwise initiate any legal or equitable action, agree to indemnify, defend, and hold harmless Hillsborough FC, its affiliated organizations and sponsors, coaches, managers, employees and associated personnel, assignees, successors, officers, directors, agents, representatives, sub-contractors, shareholders, partners, members, including the owners and lessors of the premises used to conduct the programs/sessions, all of which are hereinafter referred to as “Releases”, from any and all present and future liabilities, debts, obligations, costs, expenses, including attorneys’ fees, damages, losses, charges, judgments, executions, liens, claims, demands, actions or causes of action of whatever nature or description, in equity or at law, which the undersigned or his/her child, ward, or successors, or someone on behalf of the participant, may have, whether known or unknown, suspected or unsuspected, asserted or not asserted, arising out of or in connection with the participant’s participation in the programs/sessions offered by Hillsborough FC, including, without limitation, participant’s transportation to or from any program/session, which participation, after careful consideration, I hereby authorize and which transportation I hereby authorize.

This release and covenant is intended to be as broad and inclusive as permitted by the laws of the state in which the programs/sessions are conducted. If any portion of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

The participant has received a physical examination by a physician and has been found physically capable of participating in the programs/sessions.

I hereby give my consent to have an athletic trainer, coach and/or doctor of medicine or dentistry, or associated personnel provide the participant with medical assistance and/or treatment and agree to be financially responsible for the cost of such assistance and/or treatment.

I further grant Hillsborough FC the right to use, at its discretion, the participant’s name, picture, video (whether individual, group or team) and/or likeness in printed, broadcast or other material concerning the programs/sessions, provided such use is related to the participant’s status as a participant in the
programs/sessions.
